Poruba, obec Ostrava.<\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">(d\u00e1le jen \u201e<span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\"><span lang=\"cs-CZ\"><i><b>Spole\u010denstv\u00ed <\/b><\/i><\/span><\/span><\/span><\/span>je pr\u00e1vnickou osobou, kter\u00e1 vznikla na z\u00e1klad\u011b z\u00e1kona \u010d. 72\/1994 Sb. o vlastnictv\u00ed byt\u016f, a kter\u00e1 se \u0159\u00edd\u00ed t\u011bmito stanovami.<\/span><\/p>\n<ol start=\"2\">\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Jednotka zahrnuje byt nebo nebytov\u00fd prostor coby prostorov\u011b odd\u011blenou \u010d\u00e1st domu a pod\u00edl na spole\u010d\u00adn\u00fdch \u010d\u00e1stech domu jako v\u011bci vz\u00e1jemn\u011b spojen\u00e9 a neodd\u011bliteln\u00e9. Jednotka je v\u011bc nemovit\u00e1.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Spole\u010denstv\u00ed bylo zalo\u017eeno za \u00fa\u010delem zaji\u0161\u0165ov\u00e1n\u00ed spr\u00e1vy domu a pozemku<span style=\"color: #000000;\"><span style=\"text-decoration: line-through;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\"><span lang=\"cs-CZ\">, <\/span><\/span><\/span><\/span><\/span>kter\u00e9 jsou v pod\u00edlov\u00e9m spo\u00adluvlastnictv\u00ed jeho \u010dlen\u016f (d\u00e1le jen <span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\"><span lang=\"cs-CZ\"><i><b>\u201espr\u00e1va domu a pozemku\u201c).<\/b><\/i><\/span><\/span><\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">P\u0159i napl\u0148ov\u00e1n\u00ed sv\u00e9ho \u00fa\u010delu je Spole\u010denstv\u00ed zp\u016fsobil\u00e9 nab\u00fdvat pr\u00e1va a zavazovat se k povinnostem pou\u00adze ve v\u011bcech spojen\u00fdch se spr\u00e1vou, provozem a opravami domu a pozemku a v dal\u0161\u00edch v\u011bcech v rozsahu a zp\u016fsobem uveden\u00fdm v obecn\u011b z\u00e1vazn\u00e9m p\u0159edpise a v t\u011bchto stanov\u00e1ch.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Spole\u010denstv\u00ed nesm\u00ed podnikat, ani se p\u0159\u00edmo \u010di nep\u0159\u00edmo pod\u00edlet na podnik\u00e1n\u00ed nebo jin\u00e9 \u010dinnosti podnika\u00adtel\u016f nebo b\u00fdt jejich spole\u010dn\u00edkem nebo \u010dlenem.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Sdru\u017e\u00ed-li se Spole\u010denstv\u00ed s jin\u00fdm spole\u010denstv\u00edm vlastn\u00edk\u016f ke spolupr\u00e1ci p\u0159i napl\u0148ov\u00e1n\u00ed sv\u00e9ho \u00fa\u010delu ne\u00adbo stane-li se \u010dlenem pr\u00e1vnick\u00e9 osoby sdru\u017euj\u00edc\u00ed spole\u010denstv\u00ed vlastn\u00edk\u016f nebo vlastn\u00edky jednotek nebo jinak p\u016fsob\u00edc\u00ed v oblasti bydlen\u00ed, nesm\u00ed se zav\u00e1zat k jin\u00e9 majetkov\u00e9 \u00fa\u010dasti, ne\u017e je poskytnut\u00ed \u010dlensk\u00e9ho vkladu nebo poskytov\u00e1n\u00ed \u010dlensk\u00fdch p\u0159\u00edsp\u011bvk\u016f. Jejich \u010dlenstv\u00ed, \u010di spole\u010dn\u00e9 \u010dlenstv\u00ed vznik\u00e1:<\/span><\/p>\n<\/li>\n<\/ol>\n<ol>\n<li>\n<p align=\"LEFT\"><span style=\"font-family: Times New Roman,serif;\">dnem vzniku Spole\u010denstv\u00ed v p\u0159\u00edpadech, kdy tyto osoby nabyly vlastnictv\u00ed, \u010di spoluvlastnictv\u00ed k jednotce nejpozd\u011bji dnem vzniku Spole\u010denstv\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"LEFT\"><span style=\"font-family: Times New Roman,serif;\">dnem nabyt\u00ed vlastnictv\u00ed, \u010di spoluvlastnictv\u00ed k jednotce v p\u0159\u00edpadech, kdy tyto osoby nabyly vlastnictv\u00ed, \u010di spoluvlastnictv\u00ed k jednotce po dni vzniku Spole\u010denstv\u00ed.<\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"CENTER\"><a name=\"bookmark0\"><\/a> <span style=\"font-family: Times New Roman,serif;\"><b>\u010cl. 4<\/b><\/span><\/p>\n<p align=\"CENTER\"><a name=\"bookmark1\"><\/a> <span style=\"font-family: Times New Roman,serif;\"><b>Spole\u010dn\u00e9 \u010dlenstv\u00ed a seznam \u010dlen\u016f spole\u010denstv\u00ed<\/b><\/span><\/p>\n<ol>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Vlastn\u00edk jednotky v dom\u011b m\u016f\u017ee sv\u00e9 pr\u00e1vo k t\u00e9to jednotce rozd\u011blit na pod\u00edly, leda\u017ee to bylo vylou\u010deno.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Spoluvlastn\u00edci jednotky v dom\u011b nebo man\u017eel\u00e9 jsou spole\u010dn\u00fdmi \u010dleny Spole\u010denstv\u00ed.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Ze spole\u010dn\u00e9ho \u010dlenstv\u00ed ve Spole\u010denstv\u00ed jsou spole\u010dn\u00ed \u010dlenov\u00e9 opr\u00e1vn\u011bni a povinni spole\u010dn\u011b a nerozd\u00edl\u00adn\u011b.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Spole\u010dn\u00ed \u010dlenov\u00e9 Spole\u010denstv\u00ed maj\u00ed postaven\u00ed vlastn\u00edka jednotky v dom\u011b a maj\u00ed pr\u00e1vo na zased\u00e1n\u00ed shrom\u00e1\u017ed\u011bn\u00ed hlasovat jako jeden \u010dlen Spole\u010denstv\u00ed s v\u00e1hou hlasu odpov\u00eddaj\u00edc\u00ed spoluvlastnick\u00e9mu pod\u00edlu na spole\u010dn\u00fdch \u010d\u00e1stech domu, p\u0159i\u010dem\u017e v\u00e1ha hlasu je ned\u011bliteln\u00e1.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Spole\u010dn\u00ed \u010dlenov\u00e9 Spole\u010denstv\u00ed jsou povinni ur\u010dit a zmocnit spole\u010dn\u00e9ho z\u00e1stupce, kter\u00fd bude vykon\u00e1vat jejich pr\u00e1va v\u016f\u010di Spole\u010denstv\u00ed.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">\u010cleny Spole\u010denstv\u00ed zap\u00ed\u0161e statut\u00e1rn\u00ed org\u00e1n Spole\u010denstv\u00ed do seznamu \u010dlen\u016f spole\u010denstv\u00ed neprodlen\u011b pot\u00e9, kdy \u010dlen Spole\u010denstv\u00ed ozn\u00e1m\u00ed prokazateln\u011b nabyt\u00ed vlastnictv\u00ed jednotky. V seznamu \u010dlen\u016f spole\u00ad\u010denstv\u00ed mus\u00ed b\u00fdt u ka\u017ed\u00e9ho \u010dlena Spole\u010denstv\u00ed uvedena vedle jm\u00e9na, p\u0159\u00edjmen\u00ed, data narozen\u00ed a m\u00edsta tr\u00adval\u00e9ho pobytu t\u00e9\u017e v\u00e1ha hlasu p\u0159i hlasov\u00e1n\u00ed na shrom\u00e1\u017ed\u011bn\u00ed.<\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"CENTER\"><a name=\"bookmark2\"><\/a> <span style=\"font-family: Times New Roman,serif;\"><b>\u010cl. 5<\/b><\/span><\/p>\n<p align=\"CENTER\"><a name=\"bookmark3\"><\/a> <span style=\"font-family: Times New \u010dlen Spole\u010denstv\u00ed v pom\u011bru podle velikosti sv\u00e9ho pod\u00edlu na spole\u010dn\u00fdch \u010d\u00e1s\u00adtech.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">P\u0159i p\u0159evodu vlastnick\u00e9ho pr\u00e1va \u010dlena Spole\u010denstv\u00ed k jednotce v dom\u011b nevznik\u00e1 Spole\u010denstv\u00ed povinnost p\u0159\u00edsp\u011bvky na spr\u00e1vu domu ke dni \u00fa\u010dinnosti p\u0159evodu vypo\u0159\u00e1dat.<\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"CENTER\"><a name=\"bookmark4\"><\/a> <span style=\"font-family: Times New Roman,serif;\"><b>\u010cl. 6<\/b><\/span><\/p>\n<p align=\"CENTER\"><span style=\"font-family: Times New Roman,serif;\"><b>Pr\u00e1va a povinnosti \u010dlena Spole\u010denstv\u00ed a zp\u016fsoby jejich uplat\u0148ov\u00e1n\u00ed<\/b><\/span><\/p>\n<ol>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">\u010clen Spole\u010denstv\u00ed m\u00e1 pr\u00e1va vlastn\u00edka jednotky v dom\u011b a pr\u00e1va \u010dlena spole\u010denstv\u00ed vlastn\u00edk\u016f uveden\u00e1 v p\u0159\u00edslu\u0161n\u00fdch ustanoven\u00edch obecn\u011b z\u00e1vazn\u00fdch p\u0159edpis\u016f a t\u011bchto stanov a m\u00e1 zejm\u00e9na pr\u00e1vo:<\/span><\/p>\n<\/li>\n<\/ol>\n<ol>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">svobodn\u011b spravovat, v\u00fdlu\u010dn\u011b u\u017e\u00edvat a uvnit\u0159 stavebn\u011b upravovat svou jednotku v dom\u011b, jako\u017e i u\u017e\u00edvat spole\u010dn\u00e9 \u010d\u00e1sti, nesm\u00ed v\u0161ak zt\u00ed\u017eit jin\u00e9mu vlastn\u00edkovi jednotky v dom\u011b v\u00fdkon stejn\u00fdch pr\u00e1v ani ohrozit, zm\u011bnit nebo po\u0161kodit spole\u010dn\u00e9 \u010d\u00e1sti,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">\u00fa\u010dastnit se ve\u0161ker\u00e9 \u010dinnosti Spole\u010denstv\u00ed zp\u016fsobem a za podm\u00ednek stanoven\u00fdch obecn\u011b z\u00e1vazn\u00fdmi p\u0159edpisy a t\u011bmito stanovami,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">\u00fa\u010dastnit se zased\u00e1n\u00ed shrom\u00e1\u017ed\u011bn\u00ed, po\u017eadovat i dostat na n\u011bm vysv\u011btlen\u00ed k p\u0159edm\u011btu zased\u00e1n\u00ed shro\u00adm\u00e1\u017ed\u011bn\u00ed, krom\u011b skute\u010dnost\u00ed, kter\u00e9 z\u00e1kon uve\u0159ejnit zakazuje nebo jejich\u017e zve\u0159ejn\u011bn\u00ed by Spole\u010denstv\u00ed zp\u016fsobilo v\u00e1\u017enou \u00fajmu, a hlasov\u00e1n\u00edm se pod\u00edlet na jeho rozhodov\u00e1n\u00ed, v\u010detn\u011b \u00fa\u010dasti na rozhodov\u00e1n\u00ed mimo zased\u00e1n\u00ed shrom\u00e1\u017ed\u011bn\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">volit a b\u00fdt volen do volen\u00fdch org\u00e1n\u016f Spole\u010denstv\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">p\u0159edkl\u00e1dat org\u00e1n\u016fm Spole\u010denstv\u00ed n\u00e1vrhy a podn\u011bty ke zlep\u0161en\u00ed \u010dinnosti Spole\u010denstv\u00ed a k odstran\u011bn\u00ed nedostatk\u016f v \u010dinnosti Spole\u010denstv\u00ed a jeho org\u00e1n\u016f,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">obdr\u017eet vy\u00fa\u010dtov\u00e1n\u00ed z\u00e1loh na n\u00e1klady spojen\u00e9 se spr\u00e1vou domu a pozemku a na \u00fahradu jednotliv\u00fdch slu\u017eeb a vr\u00e1cen\u00ed p\u0159\u00edpadn\u00fdch p\u0159eplatk\u016f, a to nejpozd\u011bji do 4 m\u011bs\u00edc\u016f od skon\u010den\u00ed kalend\u00e1\u0159n\u00edho roku, za kter\u00fd je vy\u00fa\u010dtov\u00e1n\u00ed provedeno,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">na jm\u00e9no a adresu kter\u00e9hokoli vlastn\u00edka jednotky v dom\u011b nebo n\u00e1jemce v dom\u011b, kter\u00e9 je mu povinen sd\u011blit statut\u00e1rn\u00ed org\u00e1n Spole\u010denstv\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">sezn\u00e1mit se s hospoda\u0159en\u00edm Spole\u010denstv\u00ed a zp\u016fsobem spr\u00e1vy domu a pozemku, tzn. jak Spole\u010denstv\u00ed hospoda\u0159\u00ed a jak d\u016fm nebo pozemek spravuje; u Spole\u010denstv\u00ed m\u016f\u017ee nahl\u00ed\u017eet do smluv uzav\u0159en\u00fdch ve v\u011bcech spr\u00e1vy, jako\u017e i do \u00fa\u010detn\u00edch knih a doklad\u016f, p\u00edsemn\u00fdch podklad\u016f pro zased\u00e1n\u00ed a do z\u00e1pis\u016f ze zased\u00e1n\u00ed org\u00e1n\u016f Spole\u010denstv\u00ed, do smluv sjednan\u00fdch Spole\u010denstv\u00edm a do podklad\u016f, z nich\u017e vych\u00e1z\u00ed ur\u010den\u00ed v\u00fd\u0161e jeho povinnosti pod\u00edlet se na n\u00e1kladech spojen\u00fdch se spr\u00e1vou domu a pozemku a s dod\u00e1vkou slu\u017eeb spojen\u00fdch s u\u017e\u00edv\u00e1n\u00edm jednotek v dom\u011b, p\u0159\u00edp. na \u00fahrad\u011b ztr\u00e1ty Spole\u010denstv\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">nahl\u00ed\u017een\u00ed podle p\u0159edchoz\u00edho p\u00edsmene lze realizovat po p\u0159edchoz\u00ed domluv\u011b se statut\u00e1rn\u00edm org\u00e1nem Spole\u010denstv\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">obdr\u017eet na z\u00e1klad\u011b sv\u00e9 \u017e\u00e1dosti od jednotky, pop\u0159\u00edpad\u011b \u017ee takov\u00e9 dluhy nejsou,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">na n\u00e1hradu \u0161kody, kter\u00e1 mu vznikla po\u0161kozen\u00edm j\u00edm vlastn\u011bn\u00e9 jednotky v dom\u011b p\u0159i prov\u00e1d\u011bn\u00ed prac\u00ed podle odst.<span style=\"color: #000080;\"><span lang=\"zxx\"><u><a href=\"#bookmark5\"> 2.<\/a><\/u><\/span><\/span> p\u00edsm.<span style=\"color: #000080;\"><span lang=\"zxx\"><u><a href=\"#bookmark6\"> f) <\/a><\/u><\/span><\/span>tohoto \u010dl\u00e1nku stanov,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">je-li pro to d\u016fle\u017eit\u00fd d\u016fvod, navrhnout soudu, aby rozhodl o z\u00e1le\u017eitosti, ve kter\u00e9 byl na zased\u00e1n\u00ed shrom\u00e1\u017ed\u011bn\u00ed p\u0159ehlasov\u00e1n; v r\u00e1mci toho m\u016f\u017ee t\u00e9\u017e navrhnout, aby soud do\u010dasn\u011b zak\u00e1zal jednat podle napaden\u00e9ho rozhodnut\u00ed; nen\u00ed-li n\u00e1vrh pod\u00e1n do t\u0159\u00ed m\u011bs\u00edc\u016f ode dne, kdy se \u010dlen Spole\u010denstv\u00ed o roz\u00adhodnut\u00ed dozv\u011bd\u011bl, nebo dozv\u011bd\u011bt mohl, jeho pr\u00e1vo zanik\u00e1,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">je-li pro to d\u016fle\u017eit\u00fd d\u016fvod, navrhnout soudu, aby rozhodl o z\u00e1le\u017eitosti, kter\u00e1 byla shrom\u00e1\u017ed\u011bn\u00ed \u0159\u00e1dn\u011b dom\u011b vyhrazeny ve v\u00fdlu\u010dn\u00e9m u\u017e\u00edv\u00e1n\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">hradit stanoven\u00e9 p\u0159\u00edsp\u011bvky na spr\u00e1vu domu a pozemku, v\u010detn\u011b stanoven\u00fdch z\u00e1loh na \u00fahradu za slu\u017e\u00adby, a ve stanoven\u00e9 lh\u016ft\u011b uhradit p\u0159\u00edpadn\u00e9 nedoplatky vypl\u00fdvaj\u00edc\u00ed z vy\u00fa\u010dtov\u00e1n\u00ed t\u011bchto slu\u017eeb; v\u00a0p\u0159\u00edpad\u011b poru\u0161en\u00ed t\u011bchto povinnost\u00ed budou ve\u0161ker\u00e9 z\u00e1vazky \u010dlena Spole\u010denstv\u00ed v\u016f\u010di Spole\u010denstv\u00ed vym\u00e1h\u00e1ny d\u016fsledn\u011b v\u00a0souladu s\u00a0ve\u0161ker\u00fdmi platn\u00fdmi pr\u00e1vn\u00edmi p\u0159edpisy pr\u00e1vn\u00edho \u0159\u00e1du \u010cR; \u010dlen je povinen hradit ve\u0161ker\u00e9 n\u00e1klady spojen\u00e9 s\u00a0uplatn\u011bn\u00edm\/vym\u00e1h\u00e1n\u00edm jeho z\u00e1vazk\u016f v\u016f\u010di Spole\u010denstv\u00ed;<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">\u0159\u00eddit se p\u0159i u\u017e\u00edv\u00e1n\u00ed spole\u010dn\u00fdch \u010d\u00e1st\u00ed domu, pozemku a spole\u010dn\u00fdch \u010d\u00e1st\u00ed a za\u0159\u00edzen\u00ed domu obecn\u011b z\u00e1\u00advazn\u00fdmi pr\u00e1vn\u00edmi p\u0159edpisy, stanovami, usnesen\u00edmi org\u00e1n\u016f Spole\u010denstv\u00ed schv\u00e1len\u00fdch v souladu s obecn\u011b z\u00e1vazn\u00fdmi p\u0159edpisy a s t\u011bmito stanovami a pokyny pro provoz spole\u010dn\u00fdch za\u0159\u00edzen\u00ed v\u00fdrobce nebo spr\u00e1vce technick\u00fdch za\u0159\u00edzen\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">zdr\u017eet se v\u0161eho, co br\u00e1n\u00ed \u00fadr\u017eb\u011b, oprav\u011b, \u00faprav\u011b, p\u0159estavb\u011b, modernizaci, rekonstrukci \u010di jin\u00e9 zm\u011bn\u011b domu nebo pozemku, o nich\u017e bylo \u0159\u00e1dn\u011b rozhodnuto,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><a name=\"bookmark6\"><\/a> <span style=\"font-family: Times New Roman,serif;\">umo\u017enit instalaci, \u00fadr\u017ebu, v\u00fdm\u011bnu a kontrolu za\u0159\u00edzen\u00ed pro m\u011b\u0159en\u00ed plynu, vody, tepla a jin\u00fdch energi\u00ed v jednotce a ode\u010det nam\u011b\u0159en\u00fdch hodnot z t\u011bchto za\u0159\u00edzen\u00ed, pokud byl k tomu p\u0159edem vyzv\u00e1n Spole\u00ad\u010denstv\u00edm, a zdr\u017eet se v\u0161eho, co by tomuto br\u00e1nilo, jedn\u00e1-li se o havarijn\u00ed \u010di podobn\u00fd stav, je povinen umo\u017enit vstup osob a proveden\u00ed p\u0159\u00edslu\u0161n\u00fdch prac\u00ed i bez p\u0159edchoz\u00ed v\u00fdzvy Spole\u010denstv\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">zdr\u017eet se jak\u00e9hokoli jedn\u00e1n\u00ed, v\u010detn\u011b prov\u00e1d\u011bn\u00ed \u00faprav jednotky v dom\u011b v jeho vlastnictv\u00ed zp\u016fsobem, p\u0159i kter\u00e9m by zasahoval do pr\u00e1va ostatn\u00edch \u010dlen\u016f Spole\u010denstv\u00ed, p\u0159\u00edp. ohro\u017eoval v\u00fdkon vlastnick\u00e9ho pr\u00e1va ostatn\u00edch \u010dlen\u016f Spole\u010denstv\u00ed, a v p\u0159\u00edpadech, kde to stanov\u00ed obecn\u011b z\u00e1vazn\u00e9 p\u0159edpisy, prov\u00e1d\u011bt \u00fapravy jen se souhlasem v\u0161ech \u010dlen\u016f Spole\u010denstv\u00ed nebo na z\u00e1klad\u011b smlouvy o v\u00fdstavb\u011b uzav\u0159en\u00e9 se v\u0161emi vlastn\u00edky jednotek v dom\u011b,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">zdr\u017eet se ohro\u017een\u00ed, zm\u011bny nebo po\u0161kozen\u00ed spole\u010dn\u00fdch \u010d\u00e1st\u00ed nebo zt\u00ed\u017een\u00ed v\u00fdkonu opr\u00e1vn\u011bn\u00ed svobodn\u011b spravovat, v\u00fdlu\u010dn\u011b u\u017e\u00edvat a dobr\u00fdmi mravy tak, aby nedoch\u00e1ze\u00adlo k obt\u011b\u017eov\u00e1n\u00ed ostatn\u00edch \u010dlen\u016f Spole\u010denstv\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">p\u0159ed proveden\u00edm stavebn\u00edch \u00faprav jednotky nebo spole\u010dn\u00e9 \u010d\u00e1sti domu, kter\u00e1 slou\u017e\u00ed v\u00fdlu\u010dn\u011b k u\u017e\u00edv\u00e1n\u00ed \u010dlena Spole\u010denstv\u00ed p\u0159edat Spole\u010denstv\u00ed k ruk\u00e1m statut\u00e1rn\u00edho org\u00e1nu origin\u00e1ln\u00ed v\u00fdtisk projektov\u00e9 do\u00adkumentace a umo\u017enit p\u0159\u00edstup do jednotky t\u0159et\u00edm osob\u00e1m, a to i opakovan\u011b, pokud k tomu byl p\u0159edem vyzv\u00e1n Spole\u010denstv\u00edm, za \u00fa\u010delem ov\u011b\u0159en\u00ed, zda j\u00edm prov\u00e1d\u011bn\u00e9 stavebn\u00ed \u00fapravy neohro\u017euj\u00ed, nepo\u0161ko\u00adzuj\u00ed nebo nem\u011bn\u00ed spole\u010dn\u00e9 \u010d\u00e1sti,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">umo\u017enit t\u0159et\u00edm osob\u00e1m p\u0159\u00edstup do jednotky, pokud to nezbytn\u011b vy\u017eaduj\u00ed \u00fapravy, provoz, opravy apod. ostatn\u00edch jednotek nebo domu jako celku, a to na v\u00fdzvu Spole\u010denstv\u00ed 3 dny p\u0159edem, nejedn\u00e1-li se o havarijn\u00ed \u010di podobn\u00fd stav, a zdr\u017eet se v\u0161eho, co by tomuto br\u00e1nilo,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">ozn\u00e1mit Spole\u010denstv\u00ed nabyt\u00ed vlastnictv\u00ed jednotky spolu s \u00fadaji pot\u0159ebn\u00fdmi pro zaps\u00e1n\u00ed do seznamu \u010dlen\u016f a pro pot\u0159eby spr\u00e1vy domu, tzn. zejm\u00e9na:<\/span><\/p>\n<\/li>\n<\/ol>\n<ul>\n<li>\n<p align=\"LEFT\"><span style=\"font-family: Times New Roman,serif;\">svoji kontaktn\u00ed adresu,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"LEFT\"><span style=\"font-family: Times New Roman,serif;\">po\u010det osob, kter\u00e9 budou m\u00edt v jednotce Z pozv\u00e1nky mus\u00ed b\u00fdt patrn\u00e9 m\u00edsto, \u010das a po\u0159ad zased\u00e1n\u00ed. Nen\u00ed-li to mo\u017en\u00e9, vyhotov\u00ed tento z\u00e1pis osoba, kter\u00e1 zased\u00e1n\u00ed p\u0159edsedala.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Z\u00e1pis ze zased\u00e1n\u00ed org\u00e1nu Spole\u010denstv\u00ed mus\u00ed obsahovat nejm\u00e9n\u011b \u00fadaje o m\u00edst\u011b, datu a po\u0159adu zased\u00e1n\u00ed org\u00e1nu, p\u0159ijat\u00e1 usnesen\u00ed, v\u00fdsledky hlasov\u00e1n\u00ed a n\u00e1mitky \u010dlen\u016f. P\u0159\u00edlohou z\u00e1pisu je seznam \u010dlen\u016f org\u00e1nu s uveden\u00edm, kdo ze \u010dlen\u016f nebyl p\u0159\u00edtomen, pozv\u00e1nka na zased\u00e1n\u00ed a dal\u0161\u00ed podklady, kter\u00e9 byly p\u0159edlo\u017eeny k projedn\u00e1van\u00fdm z\u00e1le\u017eitostem. V z\u00e1pisu se jmenovit\u011b uvedou ti \u010dlenov\u00e9 org\u00e1nu, kte\u0159\u00ed hlasovali proti jednotliv\u00fdm usnesen\u00edm nebo se zdr\u017eeli hlasov\u00e1n\u00ed; u neuveden\u00fdch \u010dlen\u016f se m\u00e1 za to, \u017ee hlasovali pro p\u0159i\u00adjet\u00ed usnesen\u00ed. align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">N\u00e1vrh mus\u00ed obsahovat alespo\u0148 n\u00e1vrh usnesen\u00ed, podklady pot\u0159ebn\u00e9 pro jeho posouzen\u00ed nebo \u00fadaj, kde jsou uve\u0159ejn\u011bny \u00fadaje o lh\u016ft\u011b, ve kter\u00e9 se m\u00e1 \u010dlen Spole\u010denstv\u00ed vyj\u00e1d\u0159it. Nen\u00ed-li tato lh\u016fta ur\u010dena, \u010din\u00ed patn\u00e1ct dn\u00ed, kter\u00e1 po\u010d\u00edn\u00e1 b\u011b\u017eet od dojit\u00ed n\u00e1vrhu.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">K platnosti hlasov\u00e1n\u00ed se vy\u017eaduje p\u00edsemn\u00e9 vyj\u00e1d\u0159en\u00ed \u201esouhlas\u00edm\/nesouhlas\u00edm\u201c \u010dlena Spole\u010denstv\u00ed s uveden\u00edm dne, m\u011bs\u00edce a roku, kdy bylo vyj\u00e1d\u0159en\u00ed u\u010din\u011bno, podepsan\u00e9 vlastn\u00ed rukou na listin\u011b obsahu\u00adj\u00edc\u00ed pln\u00e9 zn\u011bn\u00ed n\u00e1vrhu rozhodnut\u00ed.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Statut\u00e1rn\u00ed org\u00e1n ozn\u00e1m\u00ed \u010dlen\u016fm Spole\u010denstv\u00ed v p\u00edsemn\u00e9 form\u011b v\u00fdsledek hlasov\u00e1n\u00ed a pokud bylo usne\u00adsen\u00ed p\u0159ijato, ozn\u00e1m\u00ed jim i cel\u00fd obsah p\u0159ijat\u00e9ho usnesen\u00ed. vypo\u0159\u00e1d\u00e1n\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">veden\u00ed evidence plateb \u010dlen\u016f Spole\u010denstv\u00ed, kter\u00e9 jsou podle p\u00edsmene<span style=\"color: #000080;\"><span lang=\"zxx\"><u><a href=\"#bookmark39\"> b) <\/a><\/u><\/span><\/span>tohoto odstavce shrom\u00e1\u017ed\u011bn\u00ed p\u0159ija\u00adt\u00fdch v souladu s jin\u00fdmi pr\u00e1vn\u00edmi p\u0159edpisy a se stanovami Spole\u010denstv\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">\u010dinnosti spojen\u00e9 s provozov\u00e1n\u00edm spole\u010dn\u00fdch \u010d\u00e1st\u00ed domu a technick\u00fdch za\u0159\u00edzen\u00ed, kter\u00e1 slou\u017e\u00ed i jin\u00fdm osob\u00e1m ne\u017e vlastn\u00edk\u016fm jednotek v dom\u011b, v\u010detn\u011b sjedn\u00e1v\u00e1n\u00ed s t\u00edm souvisej\u00edc\u00edch smluv,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">v\u00fdkon \u010dinnost\u00ed vztahuj\u00edc\u00edch se k uplat\u0148ov\u00e1n\u00ed ochrany pr\u00e1v vlastn\u00edk\u016f jednotek.<\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\"><i><b>Pln\u011bn\u00ed dal\u0161\u00edch povinnost\u00ed spojen\u00fdch s p\u0159edm\u011btem \u010dinnosti Spole\u010denstv\u00ed dle zvl\u00e1\u0161tn\u00edch pr\u00e1vn\u00edch p\u0159edpis\u016f<\/b><\/i><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">3. Nepln\u00ed-li vlastn\u00edk jednotky povinnost udr\u017eovat byt tak, jak to vy\u017eaduje nez\u00e1vadn\u00fd stav domu, a p\u0159\u00edmo hroz\u00ed nebezpe\u010d\u00ed, \u017ee dojde k po\u0161kozen\u00ed jin\u00e9ho bytu, je statut\u00e1rn\u00ed org\u00e1n Spole\u010denstv\u00ed povinen \u010dinit opat\u0159en\u00ed ke zjedn\u00e1n\u00ed n\u00e1pravy i v p\u0159\u00edpad\u011b, \u017ee nejde o ohro\u017een\u00ed nez\u00e1vadn\u00e9ho stavu domu jako celku. Pr\u00e1vo vlastn\u00edka jednotky \u010dinit opat\u0159en\u00ed k n\u00e1prav\u011b t\u00edm nen\u00ed dot\u010deno.<\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">4. Pro \u00fa\u010dely spr\u00e1vy domu a pozemku je statut\u00e1rn\u00ed org\u00e1n Spole\u010denstv\u00ed opr\u00e1vn\u011bn sjedn\u00e1vat smlouvy t\u00fdkaj\u00edc\u00ed se zejm\u00e9na:<\/span><\/p>\n<ol>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">zaji\u0161t\u011bn\u00ed \u010dinnost\u00ed spojen\u00fdch se spr\u00e1vou domu a pozemku, a jednotek v dom\u011b, kter\u00e9 jsou ve spolu\u00advlastnictv\u00ed v\u0161ech \u010dlen\u016f Spole\u010denstv\u00ed (administrativn\u00ed a operativn\u011b technick\u00e9 \u010dinnosti, veden\u00ed p\u0159\u00edslu\u0161\u00adn\u00e9 technick\u00e9, provozn\u00ed a ekonomick\u00e9 dokumentace),<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">zaji\u0161t\u011bn\u00ed dod\u00e1vek slu\u017eeb spojen\u00fdch s u\u017e\u00edv\u00e1n\u00edm spole\u010dn\u00fdch \u010d\u00e1st\u00ed a spojen\u00fdch s u\u017e\u00edv\u00e1n\u00edm jednotek, ne- jde-li o slu\u017eby, jejich\u017e dod\u00e1vky si vlastn\u00edci jednotek zaji\u0161\u0165uj\u00ed u dodavatele p\u0159\u00edmo,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">poji\u0161t\u011bn\u00ed domu, pozemku a org\u00e1n\u016f Spole\u010denstv\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">n\u00e1jmu spole\u010dn\u00fdch \u010d\u00e1st\u00ed domu a<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">zaji\u0161t\u011bn\u00ed provozu vybran\u00fdch technick\u00fdch za\u0159\u00edzen\u00ed spojen\u00fdch s u\u017e\u00edv\u00e1n\u00edm spole\u010dn\u00fdch \u010d\u00e1st\u00ed domu a s u\u017e\u00edv\u00e1n\u00edm jednotek, ke kter\u00fdm nem\u00e1 Spole\u010denstv\u00ed opr\u00e1vn\u011bn\u00ed je provozovat, jako jsou domovn\u00ed kotel\u00adny, v\u00fdm\u011bn\u00edkov\u00e9 (p\u0159ed\u00e1vac\u00ed) stanice, dieselagreg\u00e1ty a podobn\u00e1 vyhrazen\u00e1 technick\u00e1 za\u0159\u00edzen\u00ed.<\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">5. Statut\u00e1rn\u00ed org\u00e1n Spole\u010denstv\u00ed dohl\u00ed\u017e\u00ed na pln\u011bn\u00ed uzav\u0159en\u00fdch smluv a vym\u00e1h\u00e1 n\u00e1roky z poru\u0161en\u00ed povin\u00adnost\u00ed druh\u00e9 smluvn\u00ed strany.<\/span><\/p>\n<p align=\"CENTER\"><a name=\"bookmark40\"><\/a> <span style=\"font-family: Times New Roman,serif;\"><b>\u010cl. 16<\/b><\/span><\/p>\n<p align=\"CENTER\"><span style=\"font-family: Times New Roman,serif;\"><b>N\u011bkter\u00e9 dal\u0161\u00ed \u010dinnosti Spole\u010denstv\u00ed p\u0159i spr\u00e1v\u011b domu a pozemku<\/b><\/span><\/p>\n<ol>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">V p\u016fsobnosti statut\u00e1rn\u00edho org\u00e1nu Spole\u010denstv\u00ed je rozhodov\u00e1n\u00ed o nabyt\u00ed, zcizen\u00ed nebo zat\u00ed\u017een\u00ed movit\u00fdch v\u011bc\u00ed, jejich\u017e po\u0159izovac\u00ed cena nedos\u00e1hne v kalend\u00e1\u0159n\u00edm roce souhrnn\u00e9 \u010d\u00e1stky 20.000,&#8211; K\u010d, d\u00e1le rozho\u00addov\u00e1n\u00ed o zcizen\u00ed nebo zat\u00ed\u017een\u00ed movit\u00fdch v\u011bc\u00ed, jejich\u017e z\u016fstatkov\u00e1 cena v kalend\u00e1\u0159n\u00edm roce nep\u0159esahuje v souhrnu 10.000,&#8211; K\u010d; to neplat\u00ed, pokud shrom\u00e1\u017ed\u011bn\u00ed rozhodne jinak.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">V p\u016fsobnosti statut\u00e1rn\u00edho org\u00e1nu Spole\u010denstv\u00ed je rozhodov\u00e1n\u00ed o oprav\u011b nebo stavebn\u00ed \u00faprav\u011b spole\u010d\u00adn\u00fdch \u010d\u00e1st\u00ed nemovit\u00e9 v\u011bci, nep\u0159evy\u0161uj\u00ed-li n\u00e1klady v jednotliv\u00fdch p\u0159\u00edpadech \u010d\u00e1stku 3.000,&#8211; K\u010d v pr\u016fm\u011bru na ka\u017edou jednotku v dom\u011b; tento limit neplat\u00ed, pokud se jedn\u00e1 o opravy zp\u016fsoben\u00e9 hav\u00e1ri\u00ed na spole\u010d\u00adn\u00fdch \u010d\u00e1stech, pokud se jedn\u00e1 o za\u0159\u00edzen\u00ed s\u00a0platnou dobou funk\u010dnosti, nebo pokud shrom\u00e1\u017ed\u011bn\u00ed rozhodne jinak.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">K nabyt\u00ed, zcizen\u00ed nebo zat\u00ed\u017een\u00ed nemovit\u00fdch v\u011bc\u00ed ve vlastnictv\u00ed Spole\u010denstv\u00ed nebo k jin\u00e9mu nakl\u00e1d\u00e1n\u00ed s nimi m\u016f\u017ee shrom\u00e1\u017ed\u011bn\u00ed d\u00e1t p\u0159edchoz\u00ed souhlas jen v p\u0159\u00edpad\u011b, jde-li o nabyt\u00ed nemovit\u00e9 v\u011bci pro \u00fa\u010dely spr\u00e1vy domu a pozemku; rozhodov\u00e1n\u00ed v t\u00e9to z\u00e1le\u017eitosti statut\u00e1rn\u00edmu org\u00e1nu Spole\u010denstv\u00ed nep\u0159\u00edslu\u0161\u00ed.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Ke sjedn\u00e1n\u00ed \u00fav\u011bru a k uzav\u0159en\u00ed smlouvy o z\u0159\u00edzen\u00ed z\u00e1stavn\u00edho pr\u00e1va k jednotce dom\u011b, pokud dot\u010den\u00fd vlastn\u00edk jednotky v p\u00edsemn\u00e9 form\u011b s uzav\u0159en\u00edm z\u00e1stavn\u00ed smlouvy souhlasil, je opr\u00e1vn\u011bno shrom\u00e1\u017ed\u011bn\u00ed d\u00e1t souhlas jen pro \u00fa\u010dely spr\u00e1vy domu a pozemku, p\u0159edev\u0161\u00edm pro opravy, \u00fapravy spole\u010dn\u00fdch \u010d\u00e1st\u00ed domu nebo zm\u011bny stavby, jejich\u017e realizace byla schv\u00e1lena usnesen\u00edm shrom\u00e1\u017ed\u011bn\u00ed.<\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"CENTER\"><a name=\"bookmark41\"><\/a> <span style=\"font-family: Times New Roman,serif;\"><b>\u010cl. 17<\/b><\/span><\/p>\n<p align=\"CENTER\"><span style=\"font-family: Times New Roman,serif;\"><b>Zaji\u0161\u0165ov\u00e1n\u00ed spr\u00e1vy domu a dal\u0161\u00edch \u010dinnost\u00ed na z\u00e1klad\u011b smlouvy se spr\u00e1vcem<\/b><\/span><\/p>\n<ol start=\"3\">\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Spole\u010denstv\u00ed je opr\u00e1vn\u011bno uzav\u0159\u00edt se t\u0159et\u00ed osobou (d\u00e1le <span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\"><span lang=\"cs-CZ\"><i><b>jen \u201espr\u00e1vce\u201c)<\/b><\/i><\/span><\/span><\/span><\/span> smlouvu o zaji\u0161\u0165ov\u00e1n\u00ed n\u011bkter\u00fdch \u010dinnost\u00ed spr\u00e1vy domu a pozemku p\u0159i dodr\u017een\u00ed podm\u00ednek stanoven\u00fdch pro tento postup obecn\u011b z\u00e1vaz\u00adn\u00fdmi pr\u00e1vn\u00edmi p\u0159edpisy, t\u011bmito stanovami a usnesen\u00edmi shrom\u00e1\u017ed\u011bn\u00ed.<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">Smlouva se spr\u00e1vcem obsahuje zejm\u00e9na:<\/span><\/p>\n<\/li>\n<\/ol>\n<ol>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">vymezen\u00ed \u010dinnost\u00ed, kter\u00e9 bude vykon\u00e1vat spr\u00e1vce,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">pr\u00e1va a povinnosti spr\u00e1vce a Spole\u010denstv\u00ed,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">cenu za spr\u00e1vu, p\u0159\u00edp. jej\u00ed konstrukci,<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">podm\u00ednky pro ukon\u010den\u00ed smluvn\u00edho vztahu jak ze strany spr\u00e1vce, tak ze strany Spole\u010denstv\u00ed (odstou\u00adpen\u00edm, v\u00fdpov\u011bd\u00ed apod&#8230;),<\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\">dal\u0161\u00ed n\u00e1le\u017eitosti stanoven\u00e9 shrom\u00e1\u017ed\u011bn\u00edm.<\/span><\/p>\n<\/li>\n<\/ol>\n<p>Uzav\u0159en\u00edm smlouvy se spr\u00e1vcem podle p\u0159edchoz\u00edch odstavc\u016f nem\u016f\u017ee b\u00fdt dot\u010dena v\u00fdlu\u010dn\u00e1 rozhodovac\u00ed p\u016fsobnost org\u00e1nu Spole\u010denstv\u00ed plynouc\u00ed z obecn\u011b Slou\u017e\u00ed-li n\u011bkter\u00e1 ze spole\u010dn\u00fdch \u010d\u00e1sti jen n\u011bkter\u00e9mu \u010dlenu Spole\u010denstv\u00ed k v\u00fdlu\u010dn\u00e9mu u\u017e\u00edv\u00e1n\u00ed, stanov\u00ed se v\u00fd\u0161e p\u0159\u00edsp\u011bvku i se z\u0159etelem k povaze, rozm\u011br\u016fm a um\u00edst\u011bn\u00ed t\u00e9to \u010d\u00e1sti a rozsahu povinnosti vlastn\u00edka jednotky
